1. About us

AberIrvine Media ("AberIrvine", "we", "us", "our") is a UK live streaming and media production company. These Terms govern (a) your use of aberirvine.com and (b) any production, broadcast, streaming, or creative-media services we provide to you ("Services"). By using the website or engaging us for Services, you agree to these Terms.

2. Quotations & engagement

Quotations are valid for 30 days from the date of issue unless we state otherwise in writing. A binding engagement is formed only when you accept a written quotation (or sign a Statement of Work) and we acknowledge it. The accepted quotation, together with these Terms, forms the contract between us.

If a quotation or Statement of Work conflicts with these Terms, the quotation or Statement of Work takes precedence for that engagement.

3. Bookings, postponement & cancellation

Dates are reserved on confirmation in writing. If you postpone or cancel a booking the following applies, calculated against the value of the booking:

More than 28 days before the event: any deposit paid is non-refundable but may, at our discretion, be credited against a rescheduled date within six months. 14-28 days before: 50% of the booking value remains payable. Less than 14 days: 100% of the booking value remains payable. Third-party costs already committed (kit hire, freelancers, venue, travel) are payable in full regardless of timing.

4. Fees & payment

Unless agreed otherwise in writing, a deposit of 30% is payable on confirmation, with the balance due within 14 days of the event date. Sums are quoted in GBP and exclude VAT (where applicable) and out-of-pocket expenses (travel, accommodation, third-party kit hire, contribution costs).

We reserve the right to charge interest on overdue sums at 4% above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Crew, equipment & substitution

We provide suitably qualified crew and equipment to deliver the Services. If a named crew member becomes unavailable we may substitute equivalent personnel. We carry public liability insurance; details available on request.

6. Your responsibilities

You agree to provide safe, lawful, and reasonable access to the venue, including a power supply, network connectivity, and rigging permissions where required. You are responsible for obtaining all necessary venue, talent, music, and rights-holder clearances, unless we have agreed in writing to procure them on your behalf.

7. Intellectual property & footage

On full payment, you receive a non-exclusive, perpetual licence to use the finished deliverables for the agreed purpose. Raw camera footage, project files, and pre-production materials remain our property unless expressly transferred in writing. We retain the right to use deliverables and stills in our portfolio and showreel unless you tell us otherwise in writing before the event.

The AberIrvine Media name, logo, and the design and content of this website are our intellectual property, protected by UK and international laws. You may not copy, reproduce, or republish them without our prior written permission.

8. Confidentiality

Each party will keep confidential any non-public information disclosed by the other in the course of the engagement, and will use it solely for the purposes of delivering or receiving the Services.

9. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot lawfully be limited or excluded.

Subject to the above, our total aggregate liability arising out of or in connection with any engagement (whether in contract, tort, including negligence, breach of statutory duty, or otherwise) is limited to the total fees paid by you to us under that engagement.

We will not be liable for any indirect, consequential, or special loss, or for loss of profits, revenue, opportunity, goodwill, anticipated savings, or data.

10. Force majeure

Neither party is liable for failure to perform caused by events beyond reasonable control, including (without limitation) acts of God, severe weather, civil unrest, strike action, network or power outages affecting the venue, or government action including public-health measures.

11. Website use

You may use this website for lawful, personal, and business purposes only. You must not attempt to gain unauthorised access to the site or any connected systems, introduce malicious code, or use the site in a way that could damage, disable, overburden, or impair it.

12. Termination

Either party may terminate an engagement on written notice if the other commits a material breach which is not remedied within 14 days of being notified, or becomes insolvent. On termination, all sums payable for work performed up to the termination date become immediately due.

13. Governing law & jurisdiction

These Terms are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising out of or in connection with these Terms.
